Litigation Attorney – Workers' Compensation

 

Job Summary
An established organization is seeking an experienced Workers Compensation Trial Attorney to join their team. Matters may include complex or specialized cases such as workers compensation defense, asbestos matters, and workers compensation lien actions. The ideal candidate will have extensive expertise in the field of workers compensation.

 

Responsibilities

  • Handle insurance defense or coverage matters from pleadings through trial.
  • Manage litigation preparation with a focus on achieving strong results.
  • Develop litigation strategy and prepare/direct preparation of necessary materials, including briefs, motions, discovery, depositions, and expert testimony.
  • Advise on case strategy, including whether matters should be tried or settled, and drive timely resolution.
  • Serve as first chair in bench and jury trials in state and federal courts.
  • Manage all aspects of trials, including court appearances, trial preparation, motions, discovery, and negotiations.
  • Communicate regularly and concisely with clients, claim professionals, and leadership to ensure proper case management documentation and understanding.
  • Conduct legal research and analysis to provide guidance on legal issues and questions.
  • Prepare legal opinions and position papers on various matters.
  • Counsel clients and claim professionals on sound decision-making, including when changes in law occur.
  • Collaborate with clients, claim professionals, underwriting, risk control, and third parties to resolve legal issues.
  • Work independently on case resolution with oversight as needed.
  • Respond to government regulatory agencies as required.
  • Defend asbestos matters as part of the caseload.

 

Qualifications, Education, & Experience

  • Juris Doctor (JD) and admission to the California Bar.
  • Minimum of 2–5 years of relevant experience.
  • Strong knowledge of workers compensation law, litigation practices, and case management.
  • Proven trial and/or litigation experience with a successful track record.
  • Experience managing an independent caseload.
  • Excellent communication, negotiation, and presentation skills.
  • Strong consultative skills with ability to collaborate across teams and with external partners.
  • Analytical and problem-solving ability with a proactive, strategic approach.
  • Proficiency in Microsoft Office Suite and case management software.

 

Compensation Package

  • Salary range: $120K–$200K, plus bonus potential
